Terms of Service

1. What PurplePilot is

PurplePilot is a browser-based data-entry assistant for individual real estate agents, provided by PurplePilot Inc. ("PurplePilot Inc.", "we", "us"), a Delaware corporation with its principal place of business in Austin, Texas. It helps you capture property information from webpages you already have open and reuse it to fill in forms on other portals. It is not a transaction management platform, document-management system, CRM, or brokerage back-office system.

2. You remain responsible

PurplePilot assists with data entry. You remain responsible for reviewing all information before it is used or submitted anywhere. PurplePilot does not provide legal advice and does not guarantee compliance with MLS, brokerage, state, or local requirements. You must verify all information before submission, and you — not PurplePilot — click the final submit button on any destination site.

3. No automatic submissions

PurplePilot never submits a legally binding form automatically. Autofill always requires your review and your explicit action to submit on the destination site.

4. Plans and billing

PurplePilot offers a Free plan and a Pro plan billed monthly through Stripe. Plan limits are described on the Pricing page and enforced server-side. You can cancel or manage your subscription at any time through the Billing page.

5. Your authorization and acceptable use

You are solely responsible for ensuring you have the right to use PurplePilot with any website, account, or data. You represent and warrant that you have all necessary rights, licenses, permissions, and authorizations to access, capture, store, and reuse the data you use with the service, and that doing so does not violate any agreement, rule, license, or law that applies to you.

Being able to view data in an account does not by itself mean you are permitted to extract, copy, store, or reuse it. You are responsible for complying with the terms, rules, and data licenses of every site and service you use PurplePilot with — including, without limitation, MLS participation agreements and MLS, association, IDX, and data-use rules (such as NAR or RESO rules), and the terms of service of any source or destination website. PurplePilot grants you no rights in any third party's data.

You will not use PurplePilot to:

• access, capture, or submit data you are not authorized to access or use;
• violate or circumvent any third party's terms of service, rules, data license, or technical restrictions;
• infringe the intellectual-property, privacy, or other rights of any person;
• automate submissions without your direct review and action; or
• violate any applicable law or regulation.

You are responsible for any personal information of third parties (for example, property owners, buyers, or clients) that you capture or store using the service, and for having a lawful basis to collect and use it.

6. Termination

You may stop using PurplePilot at any time. We may suspend or terminate accounts that violate these terms.

7. Disclaimer & limitation of liability

PurplePilot is provided "as is" without warranties of any kind. To the maximum extent permitted by law, PurplePilot Inc. is not liable for indirect, incidental, or consequential damages arising from use of the service.

8. Indemnification

You agree to indemnify, defend, and hold harmless PurplePilot Inc. and its owners, operators, and affiliates from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the service; (b) your breach of these terms; (c) your violation of any third-party agreement, rule, license, or terms of service, including any MLS or association rule or data license; or (d) your violation of any law or the rights of any third party, including intellectual-property and data-protection or privacy rights.

9. Changes to these terms

We may update these terms from time to time. When we make material changes, we'll update the date above and, where appropriate, notify you in the app. Continued use after an update means you accept the revised terms.

10. Governing law and venue

These terms, and any dispute arising out of or relating to them or to your use of the service, are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and PurplePilot Inc. agree to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas for any such dispute, and each party waives any objection to that venue as inconvenient. Nothing here limits a consumer's right to bring a claim in small-claims court, or any right that cannot be waived under the law of your place of residence.
